ORGANIZATIONAL CONTEXT

The staff member is a member of the UNHCR Global Service Centre in Budapest (GSC) team in Budapest and part of UNHCR’s Legal Affairs Section at UNHCR HQ.

While the Head of the GSC will provide administrative and managerial supervision, the functional supervision of the staff member will be provided by the Principal Legal Adviser/Head of Legal Affairs Service (LAS) at UNHCR HQ.

Subject to the nature of the legal issues, the staff member is required to work with different offices/ Units/ Services/ Divisions and Bureaux that are either HQ based or Field based.

FUNCTIONAL STATEMENT The position of Associate Legal Officer is a demanding position that requires discretion and confidentiality. The incumbent is expected to expedite requests and queries within a short notice while maintaining the legal validity and operational relevance of the advice. He/She will function under the functional supervision of the Principal Legal Adviser/Head of Legal Affairs Service (LAS) at HQ. His/her specific functions include:

Upon doing required research and analysis, provide advice to UNHCR (GSC, other field offices and Headquarters) on all non-refugee legal issues. Draft, review and provide legal advice on the conclusion, interpretation and legal implications of official documents in the following fields: (a) Intellectual property related: including publications, copyrights, domain name issues and the protection of UNHCR name and emblem; (b) Commercial contracts related: for the purchase of goods and/or services by UNHCR, including in the fields of Information Technology, transport, insurance and publishing; (c) Procurement related: procurement of goods and services for the Organization, Asset management; (d) Real estate purchase and lease; (e) Web-based fraud and misrepresentation; (f) Implementing instruments including Standby Agreements relating to various UNHCR operations; (g) Fundraising; both public and private sector; including corporate partnerships; (h) Application of the UN and UNHCR Financial Rules in general. Provide legal interpretation of UN Staff Regulations and Rules, Administrative Instructions and relevant policies. Provide advice on issues relating to privileges and immunities of staff and the Organization. Provide legal advice on UNHCR cases in the internal justice system, both administrative appeals and disciplinary cases. Provide legal advice on dispute resolution including arbitration or litigation; assists in establishing the case strategy; assists in drafting the legal position and appropriate pleadings and documents. Liaise with the UN Office of Legal Affairs in New York, and with legal sections in UN sister agencies on any relevant issues. On behalf of UNHCR; liaise, correspond and negotiate with relevant third parties on the legal aspects of the conclusion, interpretation and/or implementation of contracts and agreements. Any other responsibilities/function deemed necessary or as delegated by the GSC or LAS.
